1. Parties

These Terms of Service ("Terms") govern access to and use of the MyLeadTeam platform ("Service") provided by:

"Customer" or "User" means any natural person or legal entity that registers an account on the Service for business purposes. By registering or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

MyLeadTeam is a B2B SaaS platform that helps businesses discover, enrich, and contact potential leads through AI-assisted cold-email outreach. The Service includes:

  • AI-powered lead discovery using business directory and public data sources.
  • Lead profile enrichment via AI research agents (powered by Anthropic Claude).
  • Automated generation of personalised cold-email sequences and drafts.
  • Human-gated approval workflow - no email is sent without explicit Customer approval. The AI produces drafts; the Customer reviews and authorises sending.
  • Email delivery via Customer-provided SMTP accounts.
  • Campaign analytics including open, click, and reply tracking.

The Service is currently in beta. Features may change, be added, or removed at any time. The Service Provider will endeavour to provide reasonable notice of material changes.

3. Acceptable Use and Anti-Spam Obligations

MyLeadTeam is a tool for lawful B2B outreach. The Customer is solely responsible for ensuring that all outreach conducted through the Service complies with applicable law, including but not limited to:

  • GDPR / EU ePrivacy Directive: Customers targeting recipients in the European Economic Area must have a valid legal basis (such as legitimate interest under Article 6(1)(f) GDPR for genuine B2B prospecting) and must comply with opt-out obligations and Article 13/14 transparency requirements.
  • CAN-SPAM Act (USA): Customers targeting recipients in the United States must comply with all CAN-SPAM requirements including accurate sender identification, subject-line honesty, physical address inclusion, and honouring opt-out requests within 10 business days.
  • CASL (Canada): Customers targeting Canadian recipients must have express or implied consent as defined under CASL.
  • Any other applicable national law governing unsolicited commercial communications.

The following uses are strictly prohibited:

  • Sending emails to purchased or scraped lists without a lawful basis.
  • Impersonating another person, company, or brand in email content or sender identity.
  • Sending phishing, fraudulent, defamatory, or illegal content.
  • Using the Service to harass, threaten, or discriminate against individuals.
  • Circumventing unsubscribe or suppression mechanisms.
  • Overloading or attacking third-party mail infrastructure.
  • Reselling or sublicensing access to the Service without prior written consent.

The Service Provider reserves the right to suspend or terminate accounts that violate these obligations, and to cooperate with authorities investigating spam or abuse.

4. Accounts and Access

To use the Service you must register an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Promptly notifying us at support@myleadteam.com of any unauthorised use.
  • Ensuring that team members added to your organisation comply with these Terms.

One account corresponds to one organisation. Multi-tenant access is governed by the role-based permissions within the platform (owner, admin, member, viewer).

5. Intellectual Property

Service IP: All software, algorithms, UI designs, trademarks, and documentation comprising MyLeadTeam are owned by or licensed to BuildFlow. Nothing in these Terms transfers any intellectual property rights to the Customer.

Customer data: The Customer retains all ownership of data it uploads to or generates through the Service (lead lists, email copy, campaign results). The Customer grants the Service Provider a limited, non-exclusive licence to process that data solely to provide and improve the Service.

Feedback: Any suggestions or feedback the Customer provides may be used by the Service Provider without restriction or compensation.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Service Provider does not warrant that:

  • The Service will be uninterrupted, error-free, or secure at all times.
  • AI-generated email drafts or lead profiles will be accurate or suitable for any purpose.
  • Emails sent through the Service will achieve particular delivery, open, or reply rates.
  • The Service will meet the Customer's specific regulatory compliance requirements.

The Customer is solely responsible for reviewing all AI-generated content before sending and for ensuring compliance with all applicable laws.

7. Limitation of Liability

To the maximum extent permitted by Polish law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the use of or inability to use the Service.

The Service Provider's aggregate liability for any claim arising under these Terms shall not exceed the amounts paid by the Customer for the Service in the three (3) months preceding the event giving rise to the claim, or PLN 500, whichever is greater.

Nothing in these Terms limits liability for fraud, wilful misconduct, personal injury, or death caused by negligence, or any other liability that cannot be excluded under applicable Polish law.

8. Termination

Either party may terminate these Terms and close the account at any time. The Customer may delete their account via the Settings page.

The Service Provider may suspend or terminate access immediately and without notice if:

  • The Customer violates the acceptable use obligations in Section 3.
  • The Customer engages in fraudulent or illegal activity.
  • Continued access poses a risk to other users, third parties, or the platform infrastructure.

Upon termination, the Customer's access is revoked. The Service Provider will retain Customer data for up to 90 days post-termination to allow data export, after which it will be deleted in accordance with the Privacy Policy.

9. Changes to these Terms

The Service Provider may update these Terms at any time. Material changes will be communicated via email to the registered account address at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the law of the Republic of Poland, including the Polish Civil Code (Kodeks Cywilny). The parties agree to submit to the exclusive jurisdiction of the competent courts of Poland for the resolution of any dispute arising from or in connection with these Terms.

Where the Customer is a consumer under Polish or EU consumer protection law, mandatory consumer protection rights are not affected by the above choice of law and jurisdiction clause.
